Butterfly Pea Laboratory Co., Ltd. ( hereinafter referred to as "our company" ) hereby establishes the following membership terms and conditions ( hereinafter referred to as "these terms and conditions") for the online shopping site "Butterfly Pea Laboratory Online Store" ( hereinafter referred to as "this service ") operated by our company.
Chapter 1 General Provisions
Article 1 ( Scope and Changes of the Terms )
These Terms and Conditions shall apply to all use of the Service provided by our company by members as defined in Article 5 ( hereinafter referred to as "Members" ) .

If a Member uses the Service after the effective date of the revised Terms and Conditions, the Member will be deemed to have agreed to the changes to the Terms and Conditions.

The notice in the preceding paragraph will be deemed to have been given to all members when it is displayed on the top page of the website providing the Service or when it is sent to all members by email.
Article 4 ( Member's Personal Information )
Information required to use this service, such as a member's address, name, telephone number, and usage status of this service, will be registered in our database.
We will treat the information registered by members as personal information and manage it in accordance with the personal information handling policy on the website operated by Butterfly Pea Research Institute, Inc.
Chapter 2 Membership
Article 5 ( Members )
A "member" is a person who applies for registration for the Service in accordance with the procedures established by our company and whose application has been approved by our company.
Members are deemed to have accepted the terms and conditions of this Agreement at the time of registration.
Article 6 ( Approval of Registration )
We will accept your registration application in accordance with the procedures we have established, and will approve your registration after going through the necessary screening and procedures, etc. Your membership registration will be complete when we approve your registration.
Article 7 ( Disapproval of Registration and Cancellation of Approval )
If, as a result of the review under the preceding article, it is determined that the person applying for registration falls under any of the following items, we may not approve the person's registration.

[5] Any other case in which the Company determines that it is inappropriate for the individual to become a member.
Even after approving a registration, if it is discovered that the approved member falls under any of the items in the preceding paragraph, we may revoke the approval of the registration.
Article 8 ( Withdrawal )
If a member wishes to cancel their membership of this service, they must notify us in accordance with the procedures set forth by our company.
Chapter 3 Conditions of use etc.
Article 9 ( Prohibition of use outside the scope of personal use )
Members may not use any information obtained through this service beyond the scope of personal use unless approved by our company ( including obtaining approval from a third party through our company if there is a third party that holds rights to the information in question ) .
Members may not have a third party take any action that violates the preceding paragraph.
Article 10 ( Prohibition of Sales Activities )
Unless approved by our company, members may not use this service for the purpose of, or in preparation for, sales activities, profit-making, resale, or listing or selling on an auction site. Furthermore, members may not resell, resell, or list or sell on an auction site any products purchased through this service.
Article 11 ( No guarantee of the content of this service )
We do not provide any guarantees to members regarding the information provided by us or other members through this service.
Article 12 ( Temporary Suspension of Service )
If any of the following events occur, we may temporarily suspend the provision of this service without prior notice to members, and we shall not be liable for any damages suffered by members or other third parties as a result of this.
[1] When regular or emergency maintenance of the system of this service is performed.
[2] If the Service cannot be provided due to a fire, power outage, etc.
[3] If the provision of the Service becomes impossible due to a natural disaster such as an earthquake, eruption, flood, or tsunami.
[4] If the provision of the Service becomes impossible due to war, unrest, riots, civil unrest, labor disputes, etc.
[5] Any other case where the Company determines that a temporary suspension of the Service is necessary for operational or technical reasons.
Even if delays or interruptions in the provision of this service occur due to reasons other than those listed in the preceding paragraph, we shall not be liable for any damages suffered by members or other third parties as a result thereof.
Article 13 ( Prohibited matters )
Members shall not engage in the following acts while using this service.
[1] Any act that infringes the copyright or other intellectual property rights of other members, third parties, or our company.
[2] Any act that infringes on the property or privacy of other members, third parties, or our company.
[3] Any act that slanders other members, third parties, or our company.
[4] Pre-election campaigning, election campaigning, or any other similar activity
[5] Sending or posting harmful computer programs, etc.
[6] Any act that causes harm to a third party
[7] Using the Service for the purposes of sales, profit-making, resale, resale, or listing or selling on an auction site
[8] Reselling or reselling products purchased through the Service, or listing or selling them on an auction site
[9] Placing a large amount of orders that exceeds the range of orders that a typical consumer or user would normally place.
[10] Repeatedly placing and canceling orders beyond the scope of what a typical consumer or user would normally do, or refusing to accept an order after it has been placed
[11] Any act violating the restrictions on the number of purchases or quantity or other individual precautions when using the Service.
[12] Any act contrary to public order and morals
[13] Any act that is linked to a criminal act
[14] Any other act that violates laws and regulations.
If a member causes damage to a third party while using this service, the member shall resolve the matter at his/her own responsibility and expense, and shall not cause any inconvenience or damage to our company.
We shall not be liable for any damages incurred by members as a result of using this service, and shall not be obligated to pay compensation for such damages.
If a member violates this article and causes damage to our company, our company may claim compensation for the damage suffered from the member.
Article 14 ( Notification of Changes )
If there is a change in a member's address, name, telephone number, or other information that has been notified to our company, the member must promptly notify us of the change in accordance with the procedures set forth by our company.
We shall not be held responsible for any disadvantage suffered by a member due to failure to make the notification set forth in the preceding paragraph.
Article 15 ( Prohibition of Transfer )
Members may not transfer or allow a third party to use the rights they have as a member of this service, and may not buy, sell, change the name, pledge, or use as security for any other purpose.
Article 16 ( Expulsion, etc. )
If a member falls under any of the following items, we may cancel the member's membership without any prior notice or warning to the member.
[1] If you make a false statement when registering
[2] If the entered information is tampered with.
[3] If your ID or password is used fraudulently
[4] If you interfere with the operation of this service
[5] If you violate any of these Terms and Conditions
[6] If the company's reputation is seriously damaged
[7] Any other case in which the Company determines that the Member is inappropriate to be a Member.
If our company suffers damage as a result of a member falling under any of the items in the preceding paragraph, our company may claim compensation for the damage suffered, regardless of whether or not the member's membership is cancelled.
Article 17 ( Discontinuation of the Service )
We may discontinue the provision of this service by giving one month's notice to members.
The notice in the preceding paragraph will be deemed to have been accepted by all Members one month after it is displayed on the top page of the website providing the Service or sent to all Members by email.
In the event that the provision of this service is discontinued, the Company shall be exempt from claims for damages from members or third parties resulting from the discontinuation.
Article 18 ( Exclusive Jurisdiction )
In the event that litigation arises between a member and our company regarding the use of this service, the Tokyo District Court shall be the exclusive court of first instance.
Chapter 4 ID and Password Management
Article 19 (Responsibility for managing IDs and passwords )
Members shall be solely responsible for the use and management of their membership number (hereinafter referred to as "ID") and password in relation to the use of this service.
Members may not transfer, lend or allow a third party to use their ID and password.
We shall not be liable for any damages suffered by a member as a result of the unauthorized use of his/her ID and password by a third party, regardless of whether such damage was caused by the member's willful or negligent act.
If a member forgets their ID or password, they must immediately notify us and follow our instructions. Until the member notifies us, any use of the Service using that ID and password will be deemed to have been made by that member.
Article 20 (Suspension of ID Use )
If the Company becomes aware of the occurrence or possibility of unauthorized access, fraudulent use of a credit card, impersonation, or other similar incidents and deems the situation to be urgent, the Company may temporarily suspend the use of a specific ID without the Member's consent, and the Member shall consent to this.
If the member is unable to use the Service as a result of the measures taken by our company as set forth in the preceding paragraph and suffers any damage, our company shall not be held liable in any way.
Additional provisions
These Terms and Conditions will come into effect on August 25, 2024 .
